1. Chartering Services

The Company provides boat chartering services for 2-10 hour-long cruises in the region of Helsinki, Finland. The availability of our services may vary depending on factors such as weather, maintenance, and other unforeseen circumstances. We reserve the right to cancel or modify any service at any time without prior notice.

 

Alcohol is not offered on the boat. We allow customers to bring their own alcohol on board our cruises, but we ask that they drink responsibly and in moderation. If any customers become explicitly intoxicated and pose a risk to themselves, others, or the vessel, we reserve the right to end the cruise for the safety of all parties involved. We take the safety of our customers and crew seriously and appreciate everyone's cooperation in maintaining a safe and enjoyable experience on our cruises.

 

The maximum capacity of 12 guests on the boat cannot be exceeded.

 

It is your responsibility to ensure that you remove all your personal goods from the boat at the conclusion of the rental time. The Company rejects all liability regarding any objects left on the boat.


 

2. Booking and Payment

The person making the reservation is referred to as the “Renter” (you). The Renter represents that each user of the Company in their group has given you permission to accept these Terms on their behalf. You will serve as the party’s main point of contact with the Company and accept all letters and messages from it on their behalf.

 

Renters may book our services through our website, by phone, or by email. To book a charter, you must provide accurate and complete information about the number of passengers, the preferred date and time, and any other relevant details. You agree to pay the full price of the charter at the time of booking. The prices are incl. VAT.

 

We accept payments through our website using a secure payment gateway. Payment can be made using the following payment methods: Visa, Visa Electron, MasterCard, Maestro, JCB, and American Express as well as Apple Pay.

 

A minimum age of 18 is required to make a reservation with the Company. Persons under the age of 18 must be accompanied by a guardian who is at least 18 years old.

 

Before a reservation is confirmed, all advertised prices are subject to change without prior notice.

 

3. Cancellations

To confirm a booking, the Renter must agree to our cancellation policy:

• Cancellations made 7 days or more in advance of the cruise date will receive a 100% refund.

• Cancellations made within 3 - 6 days of the cruise date will receive a 50% refund.

• Cancellations made less than 72 hours before the cruise date are non-refundable.

• If the Renter fails to arrive at the scheduled time and location of the charter, without prior notice or explanation, the booking will be considered a no-show and the Renter will be charged the full price.

Otherwise applicable law regarding refunds/returns of online purchases of 14 days, does not apply to boat charters and thus Company bookings. To exercise the right to the refund you must notify us of your decision to cancel by an unequivocal statement, e.g. letter sent by email to contact@arkproject.fi specifying your name, email, and the unique booking code for the reservation we have provided to you.

If the Renter wishes to modify or reschedule a booking, they must contact us at least 7 days in advance of the cruise date. We will make reasonable efforts to accommodate modifications and rescheduling requests, subject to availability and our discretion.

 

We reserve the right to cancel a booking due to weather conditions, mechanical issues, or other unforeseen circumstances. In such cases, we will provide a full refund or reschedule the charter, at the user's discretion.

 

Gift cards and any other type of coupons are non-refundable. This is not covered by any other applicable laws governing refunds or returns of online purchases made within Europe during a 14-day period. Gift cards must be used before they expire.

 

4. Safety and Conduct

The safety of our passengers is our top priority. You agree to follow all safety instructions provided by the Company and its crew members. You also agree to behave in a responsible and respectful manner during the charter. The Company reserves the right to terminate the charter at any time if you or any of your guests engage in any behavior that endangers the safety of others or the vessel, or if you violate any of these Terms.

 

5. Liability

The Company assumes no liability for any injury, loss, or damage to you or your property during the charter, except for damages caused by our willful misconduct or gross negligence. You agree to indemnify and hold the Company harmless from any and all claims, damages, and expenses, including reasonable attorneys’ fees, arising from your use of our services.

 

If the Renter causes any accidents or damages to the boat, the Renter is required to report any damages to the Company as soon as possible and cooperate fully in resolving the issue.

• The Renter is liable for the conduct of every individual in its group. 

• The Renter is liable for any damage to the boat and its accessories; in the event of damage, you will be required to pay for all associated costs.

 

We advise that the Renter carries proper insurance in case the Renter causes any damages.

 

6. Force Majeure

The Company is not liable for unfavorable weather, or any other circumstances that are beyond its control. We make note of factual mistakes in service descriptions and potential technological issues. If a war, a natural disaster, or other occurrence that neither the Company nor the Renter could have predicted or controlled prevents the item purchased from being utilized, the parties may withdraw from the agreement.

 

7. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works of any content on our website without our prior written consent.

 

8. Links to Third-Party Websites

Our website may contain links to third-party websites that are not owned or controlled by the Company. We have no control over and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You agree to review and abide by the terms and conditions and privacy policies of any third-party websites that you access through our website.

 

9. Modifications to Terms and Website

The Company reserves the right to modify these Terms and our website at any time without prior notice. Your continued use of our website after any such modifications indicates your acceptance of the modified Terms.

 

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Finland, without giving effect to any principles of conflicts of law. Any disputes arising from or related to these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of Finland.
